Bullying & the Educational Rights of Students - Office of Civil Rights Guidance Now Available
On October 22, the US Department of Education Office for Civil Rights issued new guidance explaining that the bullying of a student with a disability on any basis (disability, race, gender, sexual orientation, etc.) can result in a denial of a free, appropriate public education under Section 504; and that this denial must be remedied by schools. The guidance also reiterates schools' obligations to address conduct that may constitute disability-based harassment and explains that schools must also remedy the denial of FAPE resulting from disability-based harassment.
